Marlboro Lights Class Action
Sellers of cancer and death should pay.Our law firm has joined with a Michigan-based specialty litigation firm in filing an Altria (formerly Philip Morris) Marlboro Lights class action. This case, presently pending in Federal Court before Federal Judge Martha Vasquez, seeks to recover damages from Altria for everyone who has purchased Marlboro Lights in the State of New Mexico. Essentially, the claim is that "Lights" really were not light at all, and in fact were only a simple effort to mislead cigarette purchasers who might otherwise have chosen to either quit smoking or chose another brand of cigarette. The lawsuit does not seek to recover for any health injury, but rather invokes a simple unfair trade practice claim. Altria, we allege, deceived consumers by providing something other than what was implied or promised. A Federal Court in Washington D.C. has recently ruled that a class action may go forward on this basis and further, actually prohibited Altria, or any other cigarette manufacturer, from selling any so called "Lights" that were not actually lighter in tar and nicotine delivered to the average consumer. That injunction is on appeal. At the time of this writing, the certification of our class action for the State of New Mexico has been denied by Judge Vasquez but is subject to a request for reconsideration. If the class action is allowed to go forward in the state of New Mexico, a method of notification for the class of cigarette consumers will be set up and approved.
