Jury Awards Medical Costs in Tripping Case
(ALBUQUERQUE, N.M.) – A Bernalillo County District Court jury awarded $200,000 to a woman who tripped and shattered her wrist while looking at a car in the lot of an Albuquerque car dealership.
David Houliston of the Will Ferguson & Associates Law Firm, New Mexico’s largest personal injury law firm, turned down an offer of $12,000 offer before trial. Houilston said that amount did not adequately address the 58-year-old woman’s medical costs.
At trial’s outset, Houliston asked for damages and costs in the amount of $154,000. After three days of testimony, on March 7, the jury took 50 minutes to return a unanimous verdict for the plaintiff that was $46,000 higher than the amount requested. A decision by a jury to return a damage award higher amount than sought is unusual.
The woman had been looking at a car in the lot of Larry H. Miller Hyundai in Albuquerque and tripped over a concrete planter, falling and shattering her wrist, evidence showed. Despite the severity of her injury – a plate and pins were required to repair her wrist – the dealership declined to acknowledge any liability.
“This case showed that when people are treated unfairly and the facts are presented to a jury, jurors do the right thing,” said Houliston, who is “AV” rated by the rating firm Martindale Hubbell. The case was tried before District Court Judge Clay Campbell.
