CPOA has determined that deadly force was not authorized when an Albuquerque Police officer hit a suspect with his car.
The Civilian Police Oversight Agency is a group dedicated to investigating incidents where police kill civilians. Two years ago. Albuquerque went to arrest a man named Danan Gabaldon on a felony warrant for stealing a vehicle. Detectives conducted a high-risk traffic stop to catch Gabaldon without alerting him. A detective stepped in front of Gabaldon’s vehicle, but it is not clear if a badge was shown. Gabaldon drove towards the detective and the detective fired. CPOA argues that the officer should have never been in that position. All officers involved in the sting were aware of Gabaldon’s flight risk and should have planned accordingly. However, poor tactics led to a tragic situation.
After the gunshots, Gabaldon tried to flee from the detective on foot. The officer got in his unmarked vehicle, drove onto the curb, and hit Gabaldon to stop him. Luckily, Gabaldon survived the near-fatal collision. It has been two years since the incident occurred, Gabaldon is still incarcerated but he may decide to file a civil suit. With the report from the CPOA exposing the policy violation by the officer, there is possibly a chance he could win a monetary reward for his injuries. Gabaldon is now planning to sure the APD.
