Ivory Lynch is facing an open count of murder for taking the law into his own hands with Nicko Fernandez.
According to the report, Lynch spotted Fernandez trying to break into his vehicle in downtown Albuquerque. Lynch confronted the man who then pointed a gun at Lynch and tried to shoot. Officers believe the gun jammed at which point Fernandez turned to run. Lynch told police he believed the community was still in danger and pursued Fernandez without calling the police. Lynch told the officer he ran the man down with his car and hit him to “knock him down”.
Police and emergency personnel arrived at the scene where they found 33-year-old Nicko Fernandez dead from his injuries. Ivory Lynch was arrested at the scene on charges of homicide by vehicle. Lynch maintains his innocence and said his actions were in self-defense. However, police say Lynch should not have taken the law into his own hands. Also, Fernandez was running away from the incident so Lynch had no legal grounds to kill him. Investigators with the Albuquerque police are looking into the crash and will determine Lynch’s punishment. Since his arrest, Ivory Lynch was bonded out of prison.
