The Family of Tito Pacheco has filed a wrongful death claim against the Albuquerque Police Department.
-The initial report stated that a man named David Barber took police on a chase after officers noticed his vehicle. Barber was wanted on a multitude of charges and police were hoping to avoid a chase but were unable to contain the reckless driver. Reports say Barber led officers on a chase that lasted about an hour. At first, police tried to be cautious, however, Barber’s driving forced officers to use a PIT maneuver to end the chase.
The PIT maneuver was successful which caused the RV to spin out of control. This caused the RV to slide across traffic at Coors and Irving which was populated with other drivers. The RV crashed into a vehicle occupied by 39-year-old Tito Pacheco. EMTs were called to the scene and they were able to transport Pacheco to the hospital. There his battle lasted a courageous three weeks before he passed from his injuries.
The lawsuit claims the APD was negligent in the crash and should have used other tactics. However, most details concerning the lawsuit have not been released at this time.
