Liability for Dog Bite Injuries
If you have been injured by a dog bite on someone else’s property, you may be able to recover damages from either or both of the following parties:
- The subject dog’s owner
- The owner of the property where the dog bite occurred
In New Mexico, victims can recover damages from the owner of the dog that bit them if they can demonstrate that the owner knew of the dog’s aggressive testimony. While this is most easily done by proof of a prior bite by the same dog, prior knowledge of aggressiveness can be established through other evidence. Notably, if prior knowledge of aggressiveness is proven, a dog’sowner may be held liable regardless of whether the owner used reasonable care to prevent the dog bite from occurring.
While negligence does not necessarily need to be proven to hold dog owners liable for injuries caused by their dogs, dog owners can be held liable for injuries under this theory of liability as well. The negligence theory of liability can also provide a basis for holding property owners liable for dog bites that occur on their property, regardless of whether or not they are the owner of the subject dog.
