Weight loss supplement necessitates liver transplant results in $725,000.00 settlement
Plaintiff was diagnosed with a liver injury and other related conditions and required a liver transplant as a result after ingesting an unsafe weight loss supplement. The company that manufactured the supplement knew its weight loss product contained dangerous ingredients which had been proven to cause many serious health problems, including death in some cases. Nonetheless, the company manufactured, distributed, promoted, advertised, marketed, and sold the product to consumers without warning about the product’s known dangers. As a result, numerous individuals suffered various health problems including, but not limited to: liver problems, stokes, cardiovascular problems, seizures, and rhabdomyolysis. Plaintiff, a victim of the company’s deception regarding its product,the plaintiff hired Will Ferguson & Associates to represent him in litigation against the company.
Claims were made against the company for negligence, strict products liability, breach of express and implied warranties, and misrepresentation. Essentially, by manufacturing a product which the company knew was unreasonably dangerous for consumer use, and by then failing to warn consumers about the dangerous risks associated with the product, the company was alleged liable for strict products liability. By telling consumers that its product was safe and effective for weight loss purposes when it knew about the dangers associated with use of its product, the company breached implied and express warranties and also made misrepresentations regarding its product.
