The wife of 39-year-old Jerry Hicks has filed a claim against the Santa Fe city government for negligence.
Jerry Hicks passed on August 7th, 2017 in a car accident with 24-year-old Megan Carrillo. According to the report, a power outage occurred, causing the city to become completely dark. Hicks was riding his motorcycle and decided to slow down at the intersection. Megan Carrillo was in her SUV and didn’t see Hicks stopped at the intersection. Hicks was thrown from his motorcycle and it’s believed his body rolled at least three times.
Emergency personnel was called to the scene and when they arrived, they did their best to save Hicks. Unfortunately, Hicks’ wounds were too severe and he was pronounced dead at the scene. Megan Carillo was arrested at the scene by police on charges of careless driving, and homicide by vehicle. But, her charges have been dropped due to a technicality. Jerry Hick’s wife has decided to take action against the city and she actually has a pretty reasonable claim. City documents show the intersection near Cerrillos and Cristo’s Road should have had a backup power source in the case of emergencies.
However, since the Santa Fe city government was negligent in installing the battery, it is likely, the Hicks estate will win. At this time it is unclear if the Hicks estate will file a lawsuit against Megan Cerrillo. We will provide updates as the story develops.
